An attorney well versed in representing suspects can often render his most valuable service early in the case by either convincing law enforcement authorities not to charge the case, or by using forensic tools to negotiate an acceptable settlement.

Many sex crimes investigation cases remain in the pre-charging phase for many weeks or many months before charges are actually brought. If a suspect in a sex crime investigation passively waits for charges to be filed, he is missing a golden opportunity to either prevent the case from being filed in the first place, or to limit his losses by negotiating a pre-indictment settlement.

Pre-Indictment Tools

  • Investigators: Attorneys can employ a private investigator to interview the alleged victims or possible witnesses, and to obtain a detailed documentary history on key figures in the case.
  • Private Polygraph: A private polygraph can be used in selective cases under appropriate circumstances. If a client undergoes a polygraph under the auspices of his attorney’s office, the results of the polygraph are confidential because they are covered by the attorney client privilege.
  • Psychosexual evaluation: An in-depth psychosexual evaluation which shows the client to not be a miscreant or predator can be used in certain situations to either prevent a criminal case from being filed or alternatively to assist the defense attorney in negotiating a pre-charging resolution of the case. Again, the results of any psychosexual evaluation are covered by the attorney-client privilege and will be used by the attorney only if the evaluation is helpful to his client’s cause.
  • Pre-indictment negotiations: A defense attorney can engage in pre-indictment negotiations with the police or prosecutors to minimize the client’s losses and to get the best possible resolution of the case before it is formally charged.
